Client's task: risk analysis and securing clients funds in paying for the property purchased.
Description: the client requested Competenz to analyze the risks in the proposed purchase of a property being auctioned as part of bankruptcy proceedings. Our legal analysis revealed significant risks, ranging from flaws in the bankruptcy proceedings to third-party claims on the property, coupled with a high risk of fraud in the proposed transaction scenario. Lacking credible information on the seller, we used the documentation available to us to construct the most likely purchase scenarios in the given circumstances.
Consequently, the client declined to buy the property on the proposed terms. Another, safer purchase option was offered via a chain of third-party arrangements.
Result: the client avoided the risk of losing US $2 million in the transaction.
